Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period during which the consumer can exercise their right of cancellation.

  • Consumer: the natural person who is not acting in the course of a trade, business, or profession and who concludes a distance contract with the entrepreneur.

  • Day: calendar day.

  • Duration transaction: a distance contract relating to a series of products and/or services whose delivery and/or purchase obligation is spread over time.

  • Durable medium: any means enabling the consumer or the entrepreneur to store information addressed to them personally in a way that allows future consultation and unchanged reproduction of the stored information.

  • Right of withdrawal: the possibility for the consumer to cancel the distance contract within the withdrawal period.

  • Entrepreneur: Frosting Chronicles, the legal entity offering products and/or services to consumers at a distance.

  • Distance contract: a contract whereby, within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, one or more means of distance communication are used exclusively up to and including the conclusion of the contract.

  • Remote communication technique: means that can be used to conclude an agreement without the consumer and the entrepreneur being in the same room at the same time.

  • General terms and conditions: the current general terms and conditions of Frosting Chronicles.


Article 2 - Applicability

These general terms and conditions apply to every offer made by Frosting Chronicles and to every distance contract and order concluded between Frosting Chronicles and the consumer.

Before the distance contract is concluded, these general terms and conditions will be made available to the consumer. If not possible, the consumer will be informed about where they can access them and will receive them free of charge upon request.

If the contract is concluded electronically, these general terms and conditions will be provided electronically in a manner that allows storage for future reference. If this is not feasible, the consumer will be informed where they can inspect the terms electronically and how they can receive them free of charge.

If specific product or service conditions apply, they will be provided alongside these general terms and conditions. In case of conflicting terms, the consumer may always invoke the provision most favorable to them.

Article 4 - The Offer

  • If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated.

  • The offer is without obligation, and Frosting Chronicles reserves the right to adjust or withdraw it.

  • Product descriptions will be complete and accurate to enable informed decisions. Images are illustrative and may not reflect exact product colors.

  • The offer will clearly state:

    • The price, including any applicable costs.

    • Shipping costs.

    • The method of payment and delivery.

    • Whether the right of withdrawal applies.

    • Any relevant terms regarding returns, warranties, and order cancellations.


Article 5 - The Contract

  • The contract is concluded when the consumer accepts the offer and meets its conditions.

  • If acceptance is made electronically, Frosting Chronicles will immediately confirm receipt of the acceptance.

  • If payment is made electronically, Frosting Chronicles ensures security measures are in place.

  • Frosting Chronicles reserves the right to refuse an order based on reasonable grounds, such as fraudulent activity or an inability to meet payment obligations.


Article 6 - Right of Withdrawal

  • The consumer has the right to cancel their purchase within 14 days after receiving the product without giving reasons.

  • The product must be returned in its original condition and packaging.

  • The consumer must notify Frosting Chronicles of their intention to cancel via email within the cooling-off period.

  • The consumer is responsible for return shipping costs.


Article 7 - Prices and Payment

  • Prices remain fixed during the validity period unless subject to VAT or other legal changes.

  • Prices may fluctuate due to market conditions beyond Frosting Chronicles’ control.

  • All product prices exclude customs duties and import taxes, which the consumer must bear.

  • Payments must be completed within 7 days of placing an order unless otherwise agreed.

  • The consumer must report inaccuracies in payment details immediately.


Article 8 - Delivery and Execution

  • Frosting Chronicles takes the utmost care in processing orders.

  • The place of delivery is the consumer’s provided shipping address.

  • Orders will be delivered within 30 days, unless otherwise agreed. If delays occur, the consumer will be notified and may cancel the order.

  • Risk of damage or loss transfers to the consumer upon delivery.


Article 9 - Warranty and Liability

  • Products must meet the agreement and reasonable expectations of reliability and usability.

  • Warranty claims must be reported in writing within 14 days of delivery.

  • The warranty does not cover damage due to misuse, unauthorized repairs, or external factors beyond Frosting Chronicles’ control.


Article 10 - Complaints and Disputes

  • Complaints must be submitted in writing within 7 days of discovering a defect.

  • Complaints will be responded to within 14 days.

  • If a complaint cannot be resolved, it becomes a dispute subject to legal resolution.

  • Contracts with Frosting Chronicles are governed by  law.


Article 11 - CESOP Compliance

  • In accordance with the 2024 Amendment of the Turnover Tax Act 1968 and CESOP regulations, Frosting Chronicles acknowledges that payment service providers may register transactions in the European CESOP system.
